This Privacy Notice and any disputes arising out of or relating to it shall be governed by and construed in accordance with the laws of the State of New Jersey, United States. Any legal action relating to this Privacy Notice shall be brought exclusively in the state or federal courts located in Hudson County, New Jersey.


14. Limitation of Liability

In Short: Our liability for privacy-related claims arising from website use is limited as described below.

To the fullest extent permitted by applicable law, BV CyberGuardian LLC's total liability to any individual for any claims arising out of or relating to this Privacy Notice or the collection, use, or disclosure of personal information through our website shall not exceed the greater of: (a) the total fees paid by you to BV CyberGuardian LLC in the twelve (12) months preceding the claim, or (b) one hundred dollars ($100.00).

Important — Managed Services Clients: The limitation of liability for any data processed in the course of providing managed cybersecurity or IT services is governed exclusively by your Master Service Agreement.
